R W Waste Limited sentenced after a reversing excavator ran over a worker in the yard

What happened

A worker sorting waste in the yard was run over by a reversing 15-tonne excavator. The company had no suitable arrangements in place to keep pedestrians safe from vehicle movements in the yard.

Injuries: Both lower legs amputated; unable to return to work since the incident.

The breach

Sections 2(1) and 3(1) of the Health and Safety at Work etc. Act 1974

The sentence

  • Fine: £1 (nominal fine, company in liquidation)
HSE inspector

What would have prevented it

Keep pedestrians and moving vehicles apart in yards with suitable arrangements, and where large vehicles must reverse, consider additional precautions and put them in place where appropriate.
