Hessle Plant Ltd fined £433,550 after a forklift fell from a trailer while reversing

What happened

An employee was returning a repaired forklift truck to a customer site by reversing it onto a trailer at approximately 6am when the forklift fell from the side of the trailer. He was thrown from his seat and became trapped between the forklift chassis and a neighbouring trailer.

Injuries: Fatal - the employee died at the scene.

  • Other sentence: £2,000 victim surcharge

“Every year there are fatal accidents caused by machinery which has not been properly maintained or inspected, and forklift truck drivers not wearing seatbelts.”

What would have prevented it

Fully inspect and maintain forklift trucks, including machines returned to existing customers, before they are operated, and monitor and enforce seatbelt use.
