Farm XS (Northern) Limited fined £4,000 after an excavator struck and ran over a worker on a waste pile

What happened

A worker, in his second week of employment, was working on a waste pile near moving vehicles with no physical separation between pedestrians and plant. He was struck from behind and run over by an excavator.

Injuries: Fractures to both feet.

The breach

Section 2(1) of the Health and Safety at Work etc. Act 1974

The sentence

  • Fine: £4,000
  • Costs: £4,285

What would have prevented it

Physically separate pedestrians from excavators and other plant working in yards and waste piles, especially for workers new to a site.
